The overall aim of the legal and policy review is to establish a high-level, strategic understanding of the current policy, legal and regulatory frameworks in Somalia. It aims to provide guidance and recommendations on strengthening environmental governance in its emerging oil and gas sector. Specifically, it will seek to: Establish the current baseline of policy/legal/ regulatory frameworks at the National and FMS levels, which support environmental governance and management in the oil and gas sector in particular, and in the energy sector in general; Identify, analyse, and assess potential gaps, differences, as well as complementarities between the policy/legal/regulatory frameworks in the environmental and the oil and gas/energy sector, and at the National and the FMS levels; Identify the current institutional architecture/structures in place which support environmental governance and management in the oil and gas sector in particular, and in the energy sector in general, at National and FMS levels; Map the mandates/roles of the different Ministries/Departments/Agencies (MDA) in both the environment and oil and gas sectors at National and FMS levels; Assess the current strengths, potential gaps, and conflicts in undertaking these mandates/roles in relation to the policy/legal/regulatory frameworks. Anticipate potential oil and gas exploration or production activities and future energy development in the country and reflect to what extent the current frameworks are ‘equipped’ to address emerging needs.
